The High Court directive to choose Mirza Abbas's nomination papers



The High Court has asked the Election Commission to send the nomination papers of BNP-nominated candidate Mirza Abbas to Returning Officer. Besides, the Returning Officer has been asked to fill his nomination papers within 24 hours.

At the same time, the court has issued a rule to know why the reason for not accepting Mirza Abbas's nomination from Dhaka-9 constituency will not be declared illegal because of the scheduled time. The court also asked why Rule did not send the nomination paper to the Returning Officer and why it would not be declared illegal by keeping it to the Chief Election Commissioner.

In the next four weeks, the Chief Election Commissioner, Election Commission Secretary, Joint Secretary (Election Management-2 Branch) and the Dhaka Divisional Commissioner and the Returning Officer of the Eleventh Jatiya Sangsad election have been asked to respond to the ruling within four weeks.

The bench of the High Court Justice FRM Nazmul Ahsan and Justice KM Kamrul Quader passed the order on Tuesday (December 4th) on the preliminary hearing of the petition filed by Mirza Abbas.

Senior lawyer Zainul Abedin argued for Mirza Abbas in the court. Barrister AKM Ehsanur Rahman was accompanied by Barrister AKM Ehsanur Rahman.

Barrister AKM Ehsanur Rahman said, "BNP's Standing Committee member Mirza Abbas could not submit the nomination papers on Nov 28 from the Dhaka-9 constituency. Later on 1 December it was submitted to the Election Commission office. According to the rules, on December 2, the nomination paper was supposed to be sent to the returning officer, but it was not done. As a result, the writ of the High Court is to be directed to complete the scrutiny of the nomination papers.

The court gave the order on the hearing of the writ.

In spite of the deadline, on November 28, Mirza Abbas's supporters in the Dhaka-9 constituency were refused permission to submit nomination papers for their nomination papers. The supporters complained, the officials of Returning Officer's office lamented to submit nomination papers on the last day after seeing Mirza Abbas's picture.

However, the election officials claimed that it was not possible to submit the nomination papers after the scheduled time was over.

The writ writers are: Chief Election Commissioner, Election Commission Secretary, Joint Secretary (Election Management-2 Branch), Dhaka Divisional Commissioner and Returning Officer of Eleven Parliamentary Elections for the Election Commission.
